Terms of Service

1. Acceptance of Terms
By using the Fit Like mobile application ("App"), you agree to these Terms of Service ("Terms"). We may update these Terms, and your continued use constitutes acceptance of changes.
2. Eligibility and Accounts
You must be at least 13 years old. Users under 18 need parental permission. You agree to provide accurate account information and maintain account security. You're responsible for all activities under your account. We may suspend or terminate accounts that violate these Terms.
3. Subscriptions, Payments, and Cancellations
Premium features require a subscription managed through app store platforms (Apple App Store or Google Play Store). Subscriptions automatically renew unless cancelled before the renewal date. Fees are charged in advance. To cancel, use your app store's subscription settings—we don't process cancellations or refunds directly. Refunds are handled by the app store per their policies. If you cancel, premium access continues until the current billing period ends. We may change prices with advance notice; changes apply to future renewals only.
4. User Content
You own content you create or upload (workouts, recipes, images, notes, etc.). By uploading content, you grant us a license to store, display, and process it to provide the Service and maintain backups. This license continues only as needed for backups and legal compliance, as described in our Privacy Policy. You're responsible for ensuring your content doesn't infringe others' rights or violate laws. We may remove content that violates these Terms. You can delete your content anytime through the App.
5. Acceptable Use
You agree not to: violate laws; infringe intellectual property rights; upload illegal or harmful content; impersonate others; disrupt the Service; gain unauthorized access; use automated systems to scrape data; reverse engineer the App; or modify the App. Violations may result in termination and legal action.
6. Fitness & Health Disclaimer
Important: This App provides fitness and recipe organization tools only. It does not provide medical, health, or nutritional advice.
No Medical Advice: Content in the App is for informational purposes only, not medical advice. Consult a healthcare professional before starting any exercise program or making dietary changes.
Use at Your Own Risk: Physical exercise and dietary changes involve risks. You're responsible for ensuring workouts and recipes are appropriate for your health and fitness level. We're not liable for injuries or health problems resulting from your use of the Service. If you experience pain or a medical emergency, stop immediately and seek medical attention. We don't guarantee accuracy or fitness outcomes.
7. Intellectual Property
The App and its content (excluding your User Content) are protected by copyright and trademark laws. "Fit Like" and related marks are our trademarks. We grant you a limited license to use the Service for personal, non-commercial use. You may not copy, modify, or create derivative works of the App.
8. Third-Party Services
The Service uses third-party services (authentication, cloud hosting, AI services, content APIs, app stores). Your use of these services is subject to their terms and privacy policies. We're not responsible for third-party service availability or accuracy. If you sign up through an affiliate referral link, we track the referral source for attribution purposes, as described in our Privacy Policy.
9. Termination
You may stop using the Service anytime by deleting the App or your account. Cancel active subscriptions through your app store to avoid future charges. We may suspend or terminate access for violations, inaccurate information, or other necessary reasons, with notice when reasonably possible. Upon termination, access ceases immediately, we may delete your account and content per our data retention policies, and you're not entitled to refunds except as required by law or app store policies. Certain provisions survive termination.
10. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT UNINTERRUPTED, SECURE, OR ERROR-FREE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE'RE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, OR DAMAGES FROM FITNESS ACTIVITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR, OR $100, WHICHEVER IS GREATER. Some jurisdictions don't allow these exclusions, so they may not apply to you.
11. Indemnification
You agree to indemnify and hold us harmless from claims arising from your use of the Service, violation of these Terms, violation of third-party rights, or your User Content. We may assume defense of any such claims.
12. Governing Law and Disputes
These Terms are governed by Delaware law. Disputes shall be resolved in Delaware courts. EU consumers may also bring proceedings in their country of residence. Subscription disputes must be resolved through the app store's dispute process.
13. Changes to Terms
We may modify these Terms at any time. We'll notify you of material changes by posting updated Terms in the App, updating the Effective Date, and/or sending email. Continued use after changes constitutes acceptance. If you don't agree, stop using the Service.
14. App Store Terms
Apple App Store: These Terms are between you and us, not Apple. Apple isn't responsible for the App. Apple has no support obligation. For warranty issues, contact Apple for a refund. Apple isn't responsible for claims about the App. We're responsible for intellectual property infringement claims. Apple is a third-party beneficiary and can enforce these Terms. Subscription disputes go through Apple's process.
Google Play Store: These Terms are between you and us, not Google. Google isn't responsible for the App. Google has no support obligation. Google is a third-party beneficiary and can enforce these Terms. Subscription disputes go through Google's process.
15. Miscellaneous
These Terms and our Privacy Policy constitute the entire agreement. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a right isn't a waiver. You may not assign these Terms; we may. Nothing creates an agency or partnership relationship. We're not liable for delays due to circumstances beyond our control, but we'll make reasonable efforts to restore service.
